Respondent Susan K. Gilbertson brought this suit against appellants Richard Leininger and Jacqueline Hess, claiming that Leininger and Hess owed her a legal duty to act for her protection after she sustained a head injury while in their home. A jury found Leininger and Hess negligent, and the court of appeals affirmed the trial courts denial of their motions for judgment notwithstanding the verdict or for a new trial. Because Leininger and Hess did not have a special relationship with Gilbertson, we reverse.
